These Terms of Service ("Terms") govern your use of the Zerf Hotel & Hospitality Assistant, a custom GPT available through OpenAI's ChatGPT platform (the "Service"), operated by Zerf LLC ("Zerf," "we," "us," or "our"). By using the Service, you agree to these Terms.

1. Description of the Service

The Service is an AI-powered hospitality assistant that allows users to explore Zerf's case studies, contact Zerf for demos or quotes, and interact with a hotel and resort demonstration featuring sample data.

2. Demo Data Disclaimer

The hotel properties, room listings, pricing, availability, local guides, and all related hospitality data presented through the Service are entirely fictional and for demonstration purposes only. They do not represent real hotels, real availability, real pricing, or real businesses. No bookings, reservations, or transactions can be made through the Service.

3. No Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Zerf does not warrant that the Service will be uninterrupted, error-free, or accurate. The demo data is illustrative only and should not be relied upon for travel planning or any other decisions.

4. Use of the Service

You agree to use the Service in compliance with all applicable laws and OpenAI's usage policies. You agree not to misuse the Service, including but not limited to attempting to extract data for commercial purposes, misrepresenting demo data as real, or using the contact feature to send spam or abusive content.

5. Intellectual Property

All content, branding, case studies, designs, and materials associated with Zerf and the Service are the property of Zerf LLC. You may not reproduce, distribute, or create derivative works from Zerf's content without prior written permission.

6. Third-Party Platforms

The Service operates on OpenAI's ChatGPT platform. Your use of ChatGPT is subject to OpenAI's Terms of Use. Zerf is not responsible for the availability, performance, or policies of OpenAI's platform.

7. Limitation of Liability

To the fullest extent permitted by law, Zerf LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed $100 USD.

8. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
